General Terms and Conditions for Access to and Use of the Flightright Customer Portal. 

 

These General Terms and Conditions (hereinafter referred to as "Portal T&Cs") govern access to and use of the online customer portal (hereinafter referred to as "Customer Portal") operated by Flightright GmbH, Revaler Str. 28, 10245 Berlin, HRB 249849 (hereinafter referred to as "Flightright") by interested consumers. By registering for the Customer Portal, you confirm that you have received and read these Portal Terms and Conditions and agree to their content. 

The Customer Portal offers you the opportunity to manage your existing cases with Flightright and view their status at . In addition, you can view your personal referral code, monitor future flights, create new cases, collect bonus points, share personal information and preferences with us, manage your membership in our loyalty programs, and communicate with us. Use of the Customer Portal is free of charge. 

 

1. Registration for the customer portal. 

You may use the customer portal if you are (i) a customer of Flightright or a customer of Flugrecht GmbH, or or (ii) have registered as a natural person. The service is not available to companies (partnerships, merchants, or legal entities). 

Before you can use the customer portal, you must successfully register on one of our websites (e.g., here). This step is not necessary for Flightright customers, as your account was automatically generated when you created your case with us. 

During registration, you must provide your email address and agree to the terms and conditions of this portal. 

 

2. Username and login. 

Your username is the email address you provided. We will send emails to this email address, for example if there is news about a flight you have booked with us. You must therefore inform us immediately (for example via the customer portal itself) if you use a new email address. Otherwise, you may experience disadvantages. 

Each time you log in, we will send a magic link to the email address you have provided. To log in to the customer portal, please click on this magic link.  

 

3. Availability of the customer portal. 

The customer portal is generally available 24 hours a day, every day of the year. However, technical reasons such as maintenance work, power outages, or disruptions to the public communications network may result in you being unable to use the customer portal temporarily or at all. 

 

4. License/use of the customer portal. 

Flightright retains ownership of the customer portal. Flightright grants you a free, non-exclusive, personal, and non-transferable license that can be revoked at any time. This license entitles you to use the customer portal exclusively for private, non-commercial purposes. Any use of the customer portal that goes beyond the terms and conditions set out in these portal terms and conditions requires the prior written consent of Flightright.

The customer portal gives you access to various services, which are described below. 

 

6. Case management. 

By clicking on " " in your account in the customer portal, you will have access to the information and documents we have stored for your case.  

We also offer you the option of communicating directly with us about your case and uploading additional documents. 

 

7. Travel Wallet. 

With our Travel Wallet, you can create future flights today. Once you have booked a flight, you can save it in the Travel Wallet. After the flight has been completed, we automatically check whether there was a delay and whether you may be entitled to compensation under the European Air Passenger Rights Directive. If this is the case, we will inform you by email. 

 

8. Electronic delivery of documents. 

By registering, you agree that we may send you messages and other documents relating to the flights you have stored in the customer portal to the email address you provided during registration. By accepting these portal terms and conditions, anyone with authorized access to the customer portal accepts electronic correspondence. Documents that require delivery by post are excluded from electronic correspondence. Flightright also reserves the right to deliver all documents via alternative communication channels (e.g., by post). You unreservedly acknowledge all transactions carried out via the customer portal using your identification details. Similarly, all instructions, orders, notifications, etc. transmitted to Flightright in this way are deemed to have been written and authorized by you. 

 

9. Sending newsletters and other e-mails. 

By registering for the customer portal, you agree to receive newsletters and other promotional emails from us at regular intervals to the address you provided during registration. You can object to receiving these messages at any time with future effect. For example, via the link contained in the footer of every promotional email. 

 

10. Responsibility and liability. 

Flightright accepts no liability for technical access to the customer portal or the services of your network operator (internet service provider) or for the hardware and software required to use the customer portal. Flightright also accepts no responsibility for the accuracy and completeness of the data and information provided on the customer portal and is not liable for any damage incurred by you as a result of transmission errors, technical defects, overloads, interruptions (including system maintenance work) or malfunctions of the telecommunications equipment. Flightright shall not be liable for the consequences of disruptions and interruptions or for damages resulting from the non-fulfillment of contractual obligations, provided that it has exercised the usual care. The above limitations of liability shall not apply in the event of injury to life, limb, or health. 

 

11. Contract term, termination. 

The contract is valid for an indefinite period. You can terminate the use of the customer portal at any time without notice. Simply send us a message. 

We may terminate the use of the customer portal at any time by giving four (4) weeks' notice to . 

You and we also have the right to terminate the use of the customer portal without notice for good cause. 

After the termination takes effect, your access to the customer portal will be permanently blocked. 

 

12. Final provisions. 

Flightright reserves the right to change these Portal Terms and Conditions at any time. Changes will be announced in writing, electronically, or by other appropriate means. They shall be deemed approved without objection within one month of notification, but in any case upon the next use of the customer portal. 

 

The law of the Federal Republic of Germany applies. For consumers who have their habitual residence in a country other than the Federal Republic of Germany at the time of conclusion of the contract, the mandatory legal provisions applicable in that country shall also apply. 

If you are a merchant and have your registered office in Germany at the time of the order, the exclusive place of jurisdiction is our registered office in Berlin. In all other respects, the applicable statutory provisions shall apply to local and international jurisdiction. 

There are no verbal side agreements. Contract amendments and deviating or supplementary individual contractual provisions to this contract must be made in writing to be effective. This also applies to the waiver of the written form clause. 

Should individual provisions of these Portal Terms and Conditions be wholly or partially invalid or void, or become wholly or partially invalid or void as a result of a change in the legal situation or due to a ruling by the highest court or in any other way, this shall not affect the validity of the remaining provisions of the General Terms and Conditions. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision whose effects come closest to the economic purpose pursued by the contracting parties with the invalid or unenforceable provision. The same applies in the event of a loophole.
